1. Acceptance of these terms

By accessing or using this website, you agree to use it lawfully and in accordance with these Terms of Use. If you do not agree with them, please do not use the site.

These terms apply to the public website and its content. A separate written proposal, statement of work, order form or client agreement may apply to services we provide. If that document conflicts with these website terms, the signed service document will normally control for that engagement.

2. Website content

We provide the site to explain Top Realty Clicks and its digital marketing services. We aim to keep descriptions, examples and general guidance useful, but website content may be updated, corrected or removed without notice.

Marketing examples and statements about possible outcomes are illustrative. Results depend on the property, market, audience, offer, budget, sales process, timing, platform conditions and many other factors. Nothing on this website is a guarantee of enquiries, site visits, sales or a particular return.

3. Enquiries and communications

You may use the contact form, email address or other contact routes shown on the site to ask about our services. You agree to provide information that is accurate to the best of your knowledge and to avoid sending confidential, sensitive or unlawful material through an initial enquiry.

The current production form is a front-end demonstration and does not transmit data until a live service is connected. After a live integration is added, the relevant processing will be described in the Privacy Policy and may also be subject to the terms of the connected email, CRM or form provider.

A request for information does not create a client relationship, reserve availability or require either party to begin a project. A project starts only when the scope, fees, timing and responsibilities are agreed through an appropriate written document.

4. Services and project scope

Our services may include campaign planning, paid advertising, content and social media, landing pages, lead-routing support, reporting and related digital marketing work. The exact deliverables, platforms, timelines, fees, approvals and exclusions should be described in the relevant proposal or service agreement.

Unless agreed otherwise, third-party media spend, platform fees, production costs, specialist vendors, travel, taxes and other external expenses are separate from our professional fees. We will aim to identify material external costs before they are incurred.

Changes and delays

Projects can change as property details, approvals, inventory, budgets or platform requirements change. We may need to revise the plan, timeline or fee where a requested change materially affects the agreed work. We will communicate material changes and seek approval where appropriate.

5. Client responsibilities

Clients are responsible for providing accurate property, pricing, availability, legal, regulatory and brand information; obtaining any permissions needed for images, testimonials, data and advertising claims; reviewing and approving material in a reasonable time; and ensuring their sales team can respond to leads generated by a campaign.

You must not ask us to publish content that is misleading, discriminatory, infringing, unlawful or likely to breach a platform rule or advertising standard. You remain responsible for the accuracy and legality of claims about a property, development, investment, finance, return, availability or urgency.

6. Intellectual property

Top Realty Clicks and its licensors retain rights in our pre-existing methods, templates, processes, writing, design systems, code, brand assets and general know-how. Unless a written agreement says otherwise, we grant the client a limited right to use final deliverables created specifically for the client after the agreed fees are paid.

Clients retain rights in materials they provide, subject to the permissions needed for us to use those materials to perform the work. You grant us the permission necessary to host, edit, reproduce, publish and adapt those materials for the agreed project.

Third-party platforms, fonts, stock assets, plugins and software remain subject to their own licences and terms.

7. Third-party platforms and links

Campaigns may use services such as advertising networks, analytics tools, social platforms, email providers, hosting providers and CRM systems. Those services are operated by third parties and may change their features, availability, policies, pricing or review decisions.

Links to other websites are provided for convenience. We do not control or endorse every external site, and you should review its terms and privacy information before using it or providing information.

8. Availability and acceptable use

We may change, suspend or restrict access to parts of the website for maintenance, security, updates or other operational reasons. You must not attempt to interfere with the site, probe its security, introduce malicious code, scrape it in a way that harms service, impersonate another person or use the site to violate law or the rights of others.

9. Liability

To the extent permitted by law, the website and its content are provided on an “as available” basis without a promise that they will be uninterrupted, error-free, complete or suitable for every purpose. We are not responsible for losses caused by third-party platforms, inaccurate information supplied by a user or client, decisions made solely from general website content, or events outside our reasonable control.

Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited. Any additional liability, warranty or remedy for paid services should be addressed in the relevant client agreement.
